What it means when a sponsor is “Subject To Action Plan”

An action plan is issued when UKVI finds a breach of sponsorship duties that is short of a serious breach. It is explicitly a corrective measure — an opportunity to fix processes so that revoking the licence does not become necessary. It is not a revocation, and it is not a prediction of one.

But it is not trivial either. While a plan is in force UKVI may apply any limitation it considers appropriate to the sponsor’s licence — including limiting how many CAS it can issue, up to and including zero.

The practical question is CAS capacity. A sponsor under an action plan may be operating under a CAS limit, and when a plan is lifted the guidance is explicit that the restored allocation may still be lower than the allocation held before the plan was imposed. That is a supply constraint on offers, not a statement about teaching quality.

The guidance also places a duty on the sponsor: “UKVI expects a sponsor to keep its students informed of how the action plan may affect them.” A student or agent asking a university directly how a plan affects their offer is asking for something the university is expected to answer.

Paragraphs 4.17 and 4.18. Nothing here indicates that any specific sponsor has had its CAS limited — UKVI does not publish which limitations apply to which sponsor.

• A compliance investigation. Where UKVI investigates and finds evidence of a breach short of a serious breach, the outcome is a charged action plan with a specified review date, and possible CAS limits until that date.
• Recruitment deficiencies. Failing the duty to do all it can to ensure prospective students are genuine, will enrol, will comply with their visa conditions and will complete their course.
• From 2027, a Red rating. A first Red under the new Basic Compliance Assessment framework brings an action plan of at least 12 months, plus a cut of at least 10% to the next CAS allocation. Those ratings are not public yet.
• Sometimes an Amber rating. Amber alone is explicitly not a breach, but where it reveals recruitment deficiencies a shorter action plan may follow.

• Lifted. Required actions taken and no other concerns: the plan is lifted and a CAS allocation is set — possibly lower than before.
• Extended or varied. Where some concerns remain, the plan and any licence restrictions can be extended.
• Escalated. If the sponsor has not taken the required actions, or further breaches emerge at review, UKVI moves to Compliance Track 2 — the route towards revocation.

Sponsors must also pay a fee to receive an action plan. Failure to pay it, to demonstrate willingness or ability to comply, or to fulfil the plan within the specified timescales is itself listed as grounds for revocation. Where a licence is revoked there is no right of appeal, and the presumption is a two-year ban from the register — extending to any parent company.

The register records that a sponsor is subject to a plan. It does not record why, when it started, what the plan requires, what the review date is, or whether any CAS limit has been applied. Action plan documents are not published, and UKVI may finalise a plan without discussing its content with the sponsor first.
